Justice Azizah Nawawi allowed the ex-parte application in chambers with the attendance of Amran’s lawyer Tan Ch’eng Leong.
This means the court can now review whether the Industrial Court came to a correct finding in dismissing Amran’s claim.
Tan told reporters Azizah did not provide any grounds for allowing the application and that a case management had been fixed for March 1.
Amran, 41, the former UM National Union of Journalists branch chairman filed the judicial review application on Jan 12 and named Utusan Melayu (Malaysia) Bhd (UMMB),and the Industrial Court as respondents.
In his application, he wants the High Court to quash the Industrial Court’s decision delivered on Oct 20 as, he said, it was made without just cause.
He wants to be reinstated to his former position without loss of seniority or be paid compensation deemed fit by the court.
He said Industrial Court chairman Siti Salwa Musa was wrong in law in ruling that his employer was justified in sacking him.
The Industrial Court had found that Amran, who joined as a cadet journalist in 2001, had issued statements, published by Malaysiakini and Harakah Daily in 2009, that were false and that had defamed his former employer.
Amran had also reported his employer to the Malaysian Anti-Corruption Commission, alleging that the company performed suspicious money transactions and which, he added, was used as a basis for his termination then.
