PBS calls for calm while CM dispute is settled in court

KOTA KINABALU: Parti Bersatu Sabah (PBS) has urged Sabahans to refrain from making rash statements and hurling invectives over the issue of who should be chief minister as the matter has been taken to court.

Its secretary-general, Johnny Mositun, said all parties should await the outcome of the move by Musa Aman, who is chairman of the state Barisan Nasional (BN) and Umno, to pursue the matter in court.

“We cannot turn back the clock on whatever transpired after the general election,” Mositun said in a statement. “I am informed that the case will come up for hearing in early July.”

He said Musa, who was the previous chief minister from 2003, was lawfully sworn in by the state governor as chief minister for another term on May 10 when he showed that he had support of 31 elected assemblymen, two from Parti Solidariti Tanah Airku (STAR) and 29 from BN.

However, he was informed by the governor’s office two days later that he was no longer the chief minister and that Parti Warisan Sabah president Shafie Apdal had been sworn in.

This was because Musa had lost the majority support with the defection of United Pasokmomogun Kadazandusun Murut Organisation (Upko) from BN to the Warisan-Pakatan Harapan alliance.

“Musa is right in law to insist he is the legitimate chief minister. There is no provision in our state constitution for him to be removed from office in this manner,” Mositun claimed.

“The proper way for his removal is by a vote of no-confidence in the state assembly, as Karanaan assemblyman Datuk Seri Masidi Manjun has stated earlier,” Mositun said.

“I agree with Masidi. It is a matter of law and not politics. The law must be upheld without fear or favour as the newly-appointed prime minister himself has pledged,” he added.

On May 17, Musa filed a suit against Sabah governor Juhar Mahiruddin for swearing in Shafie as chief minister, claiming that he remained the rightful chief minister till he resigned or lost the majority support in the state assembly.
